A – Interim MLC may be issued to –
a.To a new ship on delivery
b.When a vessel changes flag

-- c.When a shipowner assumes responsibility for the operation of a ship which is new to that shipowner An interm MLC may be issued for a period not exceeding 6 months by the Flag or RO
An interm MLC may only be issued following verification that –
a.The ship has been inspected , as far as reasonable & practicable, for the matters listed in Appendix A5-I b.Shipowner has demonstrated to the flag or RO that ship has adequate procedures to comply with the convention
c.The master is familiar with the requirements of the convention & the respnsbilties for implemntatn.

d.Relevant info has been submitted to the flag or RO to produce a declaration of maritime labr compliance DMLC II review shall be completed by the class
Then A full inspection is carried out prior expiry of interm MLC in accordance with a list of matters to meet national laws & regulations or other measures regarding working & living conditions of seafarers on ship as per appendix A5-I.

MLC applies to all ships in international Voyage 500 GT and above. Implementation – DM LC and MLC certificate is needed
DMLC (Declaration of Maritime Labor Compliance) has 2 parts :
Part 1 – drawn up by Flag state & shall
1. Identify list of matters to be inspected as per appendix A5-I
2. Identify list of national requirements
3. refer to Ship specific requirements under national legislation
4. record any substantially equivlnt provisions to achieve same goals as MLC when the laws of that country differs from the MLC.

5. clearly indicate Exemptions granted by flag

Part 2- drawn up by Made by shipowner & shall
Identify measures to ensure ongoing compliance with part 1 between inspections and continuous improvement.

Once DMLC part 2 is approved - vessel can apply for initial MLC Audit and obtain MLC certificate

2017 amendments ( EIF 2017 came in 2014 )
COFS - Certificate of financial security proof needed on board for seafarer death, injury, abandonment, long term injury due to operational hazard.

- The amendments, which apply from 18 January 2017, relate to the financial security of seafarers in cases

of abandonment (Reg 2.5), and contractual claims for compensation in the event of a seafarer's death or long-term disability due to an occupational injury, illness or hazard (Reg 4.2).

- As of 18 January 2017, all ships must have on board a certificate or other Documentation confirming that

such financial security is in place.
MLC withdrawal /cease Invalidated

1.If the relevant inspections are not completed within the periods specified as per MLC

2.It the certificate is not endorsed

3.Change of flag

4.When a shipowner ceases to assume responsibility for the operation of a ship
5.When substantial changes have been made to the structure or equipment covered in Title “Accomodatn, Recreational facilities, food & catering.

MLC Shipowner - shipowner means the owner of the ship or another org anizatn or person, such as the manager, agent or BB charterer, who has assumed the responsibility for the operation of the ship from the owner and who, on assuming such responsibility, has agreed to take over the duties and responsibilities imposed on shipowners in accordance with this Convention, regardless of whether any other org anizatn or persons fulfil certain of the duties or responsibilities on behalf of the shipowner.
