A - Explicit acceptance – In this the Amendments come into force only after a percentage of Contracting States,
usually 2/3rd , had accepted them.
- Definition as per MARPOL 73/78 article 16 - An amendment to an article of the convention shall be
deemed to have been accepted on the date on which it is accepted by two thirds of the parties, the combined merchant fleets of which constitute not less than 50 % of the GT of the world’s merchant fleet
Tacit Acceptance – In this the amendment shall enter into force at a particular time unless before the date, objections to the amendment are received from a specified number of parties.
- Definition as per MARPOL 73/78 article 16 - An amendment to an appendix to an annex to the convention
shall be deemed to have been accepted at the end of a period to be determined by the appropriate body at the time of its adoption, which period shall be less than ten months, unless within that period an objection is communicated to IMO by not less than 1/3rd of the parties or by the parties the combined merchant fleets of which constitutes not less than 50% of the GT of the world’s merchant fleet whichever condition is fulfilled.
