A-Though CLC convention was there. It was applicable for ships which were carrying liquid cargo in their cargo tanks. So basically was applicable for oil tankers
Also for claiming Bunker oil spills there were following problems
1.The Claimant had to prove that the oil was persistent oil
2.If the ship was was from another administration then it was difficult to enforce a judgement 3.The ship owner had no Insurance
4.The legal costs were high
5.Ship owner had only one valueless ship and no other assets
6. Ship owner could not pay and he was protected under the paid to be paid clause Due to this the bunker convention was adopted in 2001 which entered into force in 2008
